Prohibiting the Death Penalty for the Rape of a Child While Overlooking Wrongful Execution: Kennedy V. Louisiana

I. INTRODUCTION

When the first colonists arrived on North American soil, they permitted the death penalty for the rape of an adult or a child. (1) However, as the colonies developed, each promulgated its own rules to determine an appropriate punishment for rape. (2) In 1972, Furman v. Georgia (3) nearly halted the use of the death penalty as a punishment for the rape of an adult or a child. (4) The Court held that death constituted a cruel and unusual punishment when applied to the crime of rape, since the crime did not necessarily result in a death. (5) Though the majority of states do not permit the death penalty for the rape of an adult or a child, five other states--Georgia, Montana, Oklahoma, South Carolina, and Texas--followed Louisiana's lead and enacted statutes allowing the death penalty for the rape of a child. (6)

In deciding whether the death penalty is an appropriate punishment for the rape of a child, courts have placed great emphasis on the Eighth Amendment's guarantee that punishments not be cruel and unusual. (7) The Framers intended to prevent "tortures" and "barbarous" methods of punishment. (8) Today, courts look at legislative enactments as well as the appropriateness of the punishment in relation to the crime committed to determine whether the death penalty should be permitted as a punishment for a particular crime. (9) Ideally, this determination requires that the death penalty succeed in meeting the two goals of punishment: deterrence and retribution. (10)

In June 2008, in Kennedy v. Louisiana, (11) the United States Supreme Court overturned the Louisiana Supreme Court's decision to sentence Patrick Kennedy to death following his conviction for the rape of a child. (12) Kennedy held that a death sentence as applied to the rape of a child, a crime not resulting nor intending to result in death, violates the Eighth Amendment. (13) The significance of this holding remains to be seen; however, the Court's decision rests firmly on the belief that the Eighth Amendment prohibits the death penalty as applied to the rape of a child, because it constitutes cruel and unusual punishment. (14) In so holding, the Court recognized the possibility of wrongful execution, yet placed little emphasis on its significance or the great probability of its occurrence, especially in cases when child victims testify. (15)

This casenote will address the impact of relying on child testimony in applying the death penalty to perpetrators who rape a child. It will begin with a review of the facts and procedure of Kennedy v. Louisiana, (16) examine the history of the death penalty as applied to rape, (17) and analyze the effect of relying on child testimony in applying the death penalty to the rape of a child. (18) It will also look at the importance of societal opinions and the national consensus regarding the death penalty when applied to crimes not resulting in death, specifically rape of a child. (19) This note will then recognize the possibility of the arbitrary and capricious application of the death penalty and present necessary steps to avoid it. (20) In addition, it will analyze the goals of punishment and determine whether these goals are met when the death penalty is applied to the rape of a child. (21) Finally, this note will focus on the possibility of wrongful execution and the effects of relying on child testimony. (22) The Supreme Court in Kennedy was correct in holding that the death penalty should not be permitted in cases of child rape not resulting in death; (23) however, the Court should have prohibited the death penalty as applied to rape of a child not because it would constitute a cruel and unusual punishment, but because of the fallibility of child testimony and its effects on convictions. (24)

II. FACTS AND PROCEDURE

On the morning of March 2, 1998, an innocent child became a victim of an indescribably brutal rape. (25) Justice Kennedy appropriately acknowledged the impossibility of giving a full account of the crime which occurred, stating that "[p]etitioner's crime was one that cannot be recounted in these pages in a way sufficient to capture in full the hurt and horror inflicted on [petitioner's] victim or to convey the revulsion society, and the jury that represents it, sought to express" in punishing the offender. …

Saturday's blast was likely timed to disrupt the event in Seaside Park, officials said. No injuries were reported -- most likely because registration problems delayed the start of the race, so no one was near the garbage can when the explosion happened.

Investigators discovered three pipe-bomb-type devices wired together near the boardwalk, authorities said. An initial examination showed the devices were rudimentary, with some type of timer, and only one of them detonated, two federal law enforcement officials told CNN.

Investigators said they found similarities between this device and the bomb that exploded in New York's Chelsea neighborhood Saturday evening, but are not linking the two events at this time.

The devices in New Jersey and New York both used cell phones as timers, officials told CNN.

Authorities say the whoever made the bombs had limited experience, given that the devices in New Jersey and the one in New York failed to work as designed.

The FBI's Joint Terrorism Task Force is leading the investigation, with help from other federal, state and local officials.

"We're out there conducting interviews, we're out there securing evidence and we're making sure there is no stone left unturned," said Brad Cohen, acting special agent in charge of the Newark FBI office.

The Department of Homeland Security says it is "actively monitoring and participating in the investigations."

Al Della Fave, a spokesman for the Ocean County prosecutor's office, said he believes the blast was meant to affect the Seaside Semper Five race.

"If it was just a matter of minutes, in terms of difference, there would have been a good number of people running past that explosive device" because of its location along the race route, Della Fave said.

Registration problems at the starting line delayed the start of the race, which meant no one was near the garbage can when the explosion happened, a law enforcement official said.

"We were lucky," the official said.

Just after the explosion, Della Fave said, the area was placed on lockdown, and police deployed bomb detection dogs. He said no additional devices were found after the dogs completed their sweep.

Race officials and local authorities canceled the event, race organizers said.

"It is a real shame that that charitable run that does so many great things for the Marines is now canceled," Della Fave said. "There's no word on when it will be rescheduled, but that's where we're at right now."

Bomb experts will analyze the device and how it was made, according to CNN senior law enforcement analyst Tom Fuentes.

"It could be somebody that has grievance against the US military, possibly the Marine Corps specifically, and have nothing to do with an overseas-inspired attack like ISIS. So it still could be terrorism without being international, without being al Qaeda or ISIS or another affiliated group."

Three years ago, on April 15, double bombings near the finish line of the Boston Marathon left three people dead and more than 250 others wounded. A fourth person, an MIT police officer, was killed three days later during a manhunt for the bombing suspects.

Bombing suspect Tamerlan Tsarnaev died from gunshot wounds after his brother ran over him in a shootout while trying to escape. His brother, Dzhokhar Tsarnaev, was found guilty of 30 counts related to the bombings and sentenced to death.

'I just blacked out'

Twenty-nine people were injured in the New York explosion, one of them critically, officials say.

Among the injured were David Martinez and Brenda Abero, who spoke to CNN after they were discharged from New York's Bellevue Hospital. Both said they were lucky to be alive.

Martinez said the couple were driving through Chelsea when their car was lifted up by the force of the blast, damaging the left side of the vehicle.

"I was driving a car and next thing you know I felt an explosion," he said.

"I just blacked out, next thing I know I'm in an ambulance."

Martinez, who suffered injuries to his head and leg, was feeling "pain, a little traumatized," he said. "Thought I was close to not seeing my son again, that was the scariest part."

Abero, who is pregnant, said her baby was uninjured.

Ambulances arriving at some local hospitals were being checked by armed guards.

APS accuses 5year-old of ‘felony’

A kinder­gart­ner with autism was ac­cused of com­mit­ting a felony last year af­ter he bit a teacher es­cort­ing him to the of­fice, ac­cord­ing to an Al­bu­querque Public Schools Po­lice re­port de­tail­ing the in­ci­dent.

The al­leged bit­ing prompted three of­fi­cers to re­spond to Cor­rales Ele­men­tary School the next day — when the 5-year-old child and his mother re­turned to the school and learned he had been sus­pended. It also gen­er­ated a hear­ing with the state Chil­dren, Youth and Fam­i­lies Depart­ment.

APS now says that was all a mis­take and the in­ci­dent should not have been raised to that level.

Ul­ti­mately, the boy’s fam­ily took him out of school, and APS agreed to pay for him to be ed­u­cated pri­vately.

Both the orig­i­nal APS po­lice re­port and the CYFD let­ter no­ti­fy­ing the boy’s par­ents of an up­com­ing hear­ing re­fer to the of­fense as a felony.

Magdel and Greg Crum, the boy’s par­ents, say it’s an ex­am­ple of just how wrong things can go when a stu­dent’s spe­cial needs aren’t met in the class­room.

Their at­tor­ney, Gail Ste­wart, said it’s also an ex­am­ple of the way the dis­trict in­tim­i­dates par­ents who ques­tion their child’s ed­u­ca­tion.

“Schools fre­quently push back to in­tim­i­date fam­i­lies,” she said. “This is sim­ply one tac­tic.”

She said it was the chal­lenge of find­ing qual­ity ed­u­ca­tional re­sources for her son — both within the pub­lic school sys­tem and pri­vately — that led to the de­ci­sion to leave.

A few weeks af­ter the sus­pen­sion, his teacher was out for a week, and a sub­sti­tute filled in, Crum said.

“That mo­ment when the sub­sti­tute teacher came. That was it. That was the end of it,” she said, not­ing that chil­dren with autism of­ten strug­gle with change and that she didn’t think the sub­sti­tute was fa­mil­iar with her son’s In­di­vid­u­al­ized Ed­u­ca­tional Pro­gram.

On Thurs­day of that week, when he was be­ing taken to the front of­fice, he bit a teacher.

“There’s no blood drawn,” Magdel Crum said.

Her son bit the teacher on the hand, be­cause he was be­ing dragged to the of­fice and he didn’t know why, she said.

The APS po­lice re­port filed the day af­ter the in­ci­dent said the boy left his class­room and “be­gan go­ing to other class­rooms” with­out per­mis­sion. He wan­dered into a spe­cial ed­u­ca­tion class­room “and was do­ing fine but be­came up­set for rea­sons un­known.” When that teacher took the child to the of­fice, he bit the teacher’s hand.

Of­fi­cers re­ported that the boy was sus­pended for one day, but that he came to class the next day with his mother. She ini­tially re­fused to leave the school, but agreed af­ter the of­fi­cer told her she could be ar­rested if she did not go, po­lice said.

Crum said she went to school with her son that day, hop­ing that she could sit in class with him to help pre­vent any po­ten­tial prob­lems. Two hours into the school day, she said, an of­fi­cer ar­rived, and she stepped out­side to speak with him and the prin­ci­pal.

“I’ll never for­get, I looked at her and I looked at him, and I said, ‘Is this nec­es­sary?’ Those were my first words. And he said to me, ‘Yes. Your child bit some­one. It’s a felony,’ ” she said.

Crum re­turned to the class­room to gather her son’s be­long­ings.

“He’s stand­ing next to (my son) as if he’s tak­ing him to jail right now,” she said. As she signed him out in the front of­fice, two more of­fi­cers “show up as backup,” she said.

Chavez said that one APS of­fi­cer had re­sponded to the school and re­quested backup. No APS backup was avail­able, so the Cor­rales Po­lice Depart­ment sent two of­fi­cers, who ar­rived af­ter the dis­trict of­fi­cer had left.

Weeks later, the Crums re­ceived a let­ter from CYFD that said the boy was “al­leged to be a delin­quent child” and in­structed his fam­ily to at­tend a con­fer­ence Nov. 5.

CYFD spokesman Henry Varela said those con­fer­ences are a chance for the agency to re­view the facts of the case to de­ter­mine whether the re­port should be for­warded to the District At­tor­ney’s Of­fice or han­dled in-house.

The day af­ter that con­fer- ence, APS po­lice filed a sup­ple­men­tal re­port that said the case “should be con­sid­ered closed.” It stated that the ini­tial re­port was “mis­tak­enly sent to the Ju­ve­nile Pro­ba­tion Of­fice for re­view” when, in­stead, it “should have been for doc­u­men­ta­tion pur­poses only.” The Ju­ve­nile Pro­ba­tion Of­fice is a branch within CYFD.

“I don’t think fill­ing out the pa­per­work and fil­ing it is a mis­take,” Magdel Crum said. “And if it is, then I reckon they should do some bet­ter train­ing of their law of­fi­cials.”

Ste­wart said it’s not un­usual for el­e­men­tary school age chil­dren with dis­abil­i­ties to be the sub­jects of re­ports like the one filed in this case.

“The fact that was un­usual was that they called it a felony,” she said, adding that a mis­de­meanor ac­cu­sa­tion would be more typ­i­cal. Ste­wart said that some­times when par­ents ad­vo­cate at the school level, like the Crums did, em­ploy­ees feel at­tacked and there’s a back­lash.

“I think that the char­ac­ter­iz­ing of it as a felony was kind of gotcha,” she said. “You guys think you’re go­ing to come in and ques­tion us, and we’re telling you your child just com­mit­ted a felony.”

Due process hear­ing

The fam­ily filed a re­quest for an In­di­vid­u­als with Dis­abil­i­ties Ed­u­ca­tion Act due process hear­ing with the state Public Ed­u­ca­tion Depart­ment, which claimed that the dis­trict failed to meet the boy’s ed­u­ca­tional needs.

It de­scribed the prob­lems they en­coun­tered in the months that their child was a stu­dent at Cor­rales Ele­men­tary, in­clud­ing the re­gres­sion his par­ents said they no­ticed when he was moved to a spe­cial ed­u­ca­tion class­room fol­low­ing the bit­ing in­ci­dent.

It also al­leges that, through sus­pen­sion, school ex­clu­sion and phys­i­cal re­straint, APS pun­ished the child for “man­i­fes­ta­tions of his dis­abil­ity.”

In its re­sponse to the re­quest, APS dis­puted the al­le­ga­tions, deny­ing that the child did not re­ceive an ap­pro­pri­ate pub­lic ed­u­ca­tion.

In the end, the dis­trict agreed to pro­vide the Crums with funds to cover the costs to ed­u­cate him pri­vately. They re­ceived a lump sum, and Ste­wart said the boy will start school in Colorado next year.

A set­tle­ment agree­ment pro­vided by APS shows that the dis­trict paid the fam­ily $12,500 for the boy’s ed­u­ca­tion and an­other $8,282 for le­gal fees.

“Be­cause he was a kinder­gart­ner and be­cause they had been so bru­tally treated by the staff, they just felt it was a more holis­tic rem­edy ... to not ex­pose him to APS again,” Ste­wart said.
